Terms of Service

By creating an account or using AxnPoint Cloud (the “Service”), you agree to these Terms. If you’re using the Service for a gym or business, you agree on its behalf.

The Service

AxnPoint Cloud provides a live workout dashboard for gyms and a way for members to display their live session. We may update, improve, or change features over time.

Accounts

• You must provide accurate information and keep your login secure.
• You’re responsible for activity under your account and for your members’ use of your gym’s dashboard.
• You must verify your email to access owner features.

Trial, subscriptions & billing

• Each gym starts with a 30-day free trial. After the trial, an active subscription is required to keep the dashboard available.
• Pricing is a flat per-gym base fee plus graduated per-member pricing and session usage, shown in your currency (CAD or USD) at checkout.
• Subscriptions renew automatically until cancelled. You can cancel anytime from the billing portal; access continues to the end of the paid period.
• Except where required by law, fees are non-refundable. Taxes may apply.
• Payments are processed by our third-party payment provider; your use of payment features is also subject to that provider’s terms.

Member purchases in the mobile app

• The purchases below are made by a MEMBER inside the AxnPoint mobile app, and are separate from a gym’s dashboard subscription above. They are billed by Apple or Google to the store account that made them, never by us.
• Online Coaching is an auto-renewing monthly subscription. It renews automatically for the same period and price unless it is cancelled at least 24 hours before the current period ends.
• Cancel or manage it in your store account settings — App Store: Settings → your name → Subscriptions; Google Play: Play Store → Profile → Payments & subscriptions. Removing the app does not cancel a subscription. Access continues to the end of the paid period.
• Online Coaching gives a member the right to ask a participating AxnPoint gym for coaching and, once that gym grants it, to submit workout videos for a coach’s written review. Limits are set by that gym’s plan, are shown in the app before a video is sent, and may change if the gym changes its plan. We do not guarantee any particular coach, review turnaround, or that any given gym offers coaching.
• Ad-Free · Full Access and the single-video unlocks are one-time purchases, not subscriptions.
• Refunds for anything bought inside the app are handled by the store that sold it, under that store’s policy — not by us. Prices are shown in your currency before purchase and may change with notice for future periods.
• Your purchases follow your store account. Restore them in the app under Settings → In-App Purchases & Subscriptions.

Acceptable use

• Don’t misuse the Service, attempt to disrupt it, or access it unlawfully.
• Don’t upload content (e.g., gym logos, names) that infringes others’ rights or is unlawful or offensive.
• Display names and squad names must be family-friendly; we filter and may remove content that isn’t.

Your content

You retain ownership of content you provide (such as your gym logo and business details). You grant us a limited licence to host and display it to operate the Service. You’re responsible for having the rights to any logo or image you upload.

Health disclaimer

AxnPoint Cloud displays workout metrics for informational purposes and is not a medical device and not medical advice. Members exercise at their own risk and should consult a professional as appropriate.

Availability

We aim for high availability but provide the Service “as is” and “as available,” without warranties to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Konsolt.Beyond Technology Corporation is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid for the Service in the 12 months before the claim.

Termination

You may stop using the Service and close your account anytime. We may suspend or terminate access for breach of these Terms or to protect the Service.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
